To Brad at City Zoning and to City Attorney, and Mayor,

The Sioux Falls ordinance re signs on vehicles impermissibly discriminates against the first amendment speech rights to seek redress of governmental abuses of the City. This sign in question is not commercial speech, this content is directed to web site compilation of the very heart of first amendment rights, and is the key to freedom from tyranny in governmental actions against citizens.

This is what the constitutional rights are about, it is not to establish order amongst the populace, but is to protect citizens from abusive governmental agencies.

This is obviously an attack on our exposure of abuses by this very department. This sign in question is plastic over the windows of a Van and was first made and used during closing of our 41st Street store in September of 2003. It was used for over a month parked in front of our Minnesota store advertising the surplus movies from the 41st Street closing and we have photos of that wording on the same plastic base.

It has had other wording since then, of which we have no photos. The city agency did not hassle us about the sign until 3 years later, within a few days of the wording changed to calling attention to abuses by this very same agency that wrote this ticket attempting to stop us from content-based message.

They were fully aware it is calling attention to your abuses of protected rights of Sioux Falls citizens.

This sign on a truck is not a new issue to me, I had the same thing in a case, but was over commercial speech on my truck in Phoenix Arizona in the 70's

Therefore I am fully aware of first amendment rights to say what you want on a vehicle used in every day business and I do not have to hide it when I park it. By the way this van is used in interstate commerce and just came back from a trip to Missouri - Oklahoma.

To make a long story short, I do my own legal work and have never lost a federal case I did not appeal, and have won most of the major 9 I have had in US court of appeals. (26 in District courts around the country)

The city of Scottsdale spent over $22,000 on expert out side legal help and lost to my first amendment rights after six years in US court of appeals in San Francisco..

This includes the SD first amendment case the attorney general appealed when my first amendment rights were upheld in District court. The US court of appeals then also upheld my rights the district court had affirmed.

This is listed to let you know I am a serious defender of constitutional rights and if you persist in further harassment of my right to picket so to speak city violations of not only mine but other citizen rights I will file immediately in federal court for protection and damages not only against the city but ALL the individuals involved by name, since I have long since found they can be held individually responsible for violating my rights since they can not claim it is "just part of their job" to violate my rights.

Therefore as of Monday, my van will again be parked where ever we think is a good place to park it. It will contain the words Harassed by the city? and Sioux Falls Class Action.com

If you again harass it, we will have strong evidence of your arrogance regarding these basic constitutional rights to seek redress from governmental abuse.
